That’s because earlier today, at some point in time (we don’t know for sure when), the page just disappeared. I can’t even give a link to it; it goes right to your own home page. So in Facebook lexicon, that means it’s just GONE.

The announcement that she made on it last night (in response to Jack’s questioning of her on camera Tuesday) about her “ongoing investigation” into activities allegedly conducted by Jerry Fricker, a member of the Hardin County Board of Education, prompted such outrage that 100 or so comments after it appeared, the matter made the news in local TV stations.

And then it got the attention of our friends, the Edgar County Watchdogs.

So earlier today, John Kraft advised that he was going to be submitting a Freedom of Information Act request to the prosecutor because again, since she was the one who opted to start the mess, perhaps she’d like to let other media outlets in the state know stuff…like what prompted her to pull certain comments from appearing.

The move is largely symbolic, as now (and as pointed out in this previous post), an appeals court has ruled that state’s attorneys are not FOIA-able. However, it lets Wallace know that people are watching her now….and this might not’ve been the attention she was intending at attract. And knowing the Watchdogs, they, and their capable legal counsel, might take an appeal all the way up to the Supreme Court…and change the law to everyone’s favor, as we NEED transparency in the state’s attorney’s offices, and Wallace is the primo example of why.

And to think it all started over her insisting that she knew nothing about Tom Maynor’s past. Lying and covering up will get you nowhere, and the truth will prevail…keep watching for updates, because more is coming.

It’s been reported to Disclosure that Alecia Paige Gregg Burk, 25, ran into some trouble at Casino Aztar in Evansville a few weekends ago when she was apparently trying to find someone to entertain her other than her husband.

Vanderburgh County court documents show that in case 82D04-1302-DR-00194, the mayor’s daughter, who goes by Paige, had a divorce filing against her by her husband of a couple of years, Addison W. Burk, on February 25, 2013. However, the documents show that they have been split since November 2012, with Paige going to live with her family in Harrisburg, and Addison staying on in Evansville.

Our sources indicate that about three weekends ago, Paige and her husband, “trying to patch things up,” had gone to the casino boat and were reportedly staying at the motel or hotel there.

However, apparently Paige wasn’t happy with this and she went to one of the bars on the boat, where, witnesses say, she began “flirting and hitting on” different gentlemen, most of them old enough to be her father.

When one of the gentlemen rebuffed her, we’ve been told, she left in a snit…and, returning to her room where her husband sat, allegedly beat him bloody. And then, in order to offset the whole thing, she reportedly cleaned up the husband with hotel towels, and left them in front of the door to another room in the hotel to make it appear as though the bloody incident had occurred there.

A quick check with Vanderburgh County authorities showed that there was no police report made, although casino boat employees confirm that indeed there were bloody towels found in a room other than where the two had stayed.

The question is: how would something like this have occurred and nothing come of it? And many feel the answer is that the “influence” that being a mayor—and a state employee making $86,000-plus annually—may have tells the tale.

Disclosure attempted to contact Paige via Facebook messaging a week ago today but she denied any knowledge of any incident; however, her father confirmed it last Friday night, when he said “there were no police reports made; and they’re trying to work things out,” which might explain why there’s been no movement in the divorce filing since late March…but doesn’t explain how a 25-year-old young mother saw fit to go hit on other men while her husband was waiting back in their room, under the impression that they were trying to “work things out.”

It looks like Hardin County State’s Attorney Tara Wallace is doing exactly that.

After Jack busted her out this afternoon at her office, apparently Ms. Tara believed it would be cool to go on a F^c*book page and “clarify” what was going on, and from whence other media picked it up. Here’s what she posted on her Hardin County State’s Attorney Facebook page (don’t know how professional it is for her office to have such a thing, but hey….it’s Tara):

And while this is sensational, unprofessional, uncalled for, and a misdirection off the negative attention Jack’s attempted interview with her caused, it was a valiant effort on the part of Ms. Tara to throw people off from what’s REALLY going on. Because her tit’s in the wringer with THAT.

Recall the part of the interview where she told Jack to “FOIA for the phone records,” meaning FOIA her office?

We did. On May 31. We specifically asked for this:

Monthly phone records (calls in/out) for each phone line to/from the Hardin County State’s Attorney’s office from December 2, 2012 to the present, to include all county-issued or -funded cell phones;

All incoming/outgoing emails on all computers in the Hardin County State’s Attorney’s office from December 2, 2012 to the present;

All names that the Hardin County State’s Attorney has requested to be run through, and obtained run-through of, LEADS, from December 2, 2012 to the present.

But we of course didn’t FOIA her office. Because we knew better; we’re fairly certain her office doesn’t have a FOIA officer; instead we sent the FOIA to Jill Cowsert, County Clerk, the “Keeper of the Records” in Hardin County.

A little less than a week later, this is what we got back:

That was from Jill Cowsert. We know it wasn’t Jill that had that information; she wouldn’t know that. She got that from Ms. Tara. But we’ve been doing what we do longer than she’s been doing what she’s doing, and we know how it works. All state’s attorneys take that “out,” in that the judiciary cannot be FOIAd. But she is NOT the judiciary, as I pointed out in this next message:

But so far, we have received NOTHING in the mail. NOTHING. And so that office is in violation of a FOIA, and the attorney general’s Public Information Office will deal with them.

We were NOT FOIAing because of any issue with JT’s father, however. We’ve been hearing about that for the past two years now. This is not news to us. We don’t know if it’s the truth or not; but that’s not up to us to determine. What it’s up to is Ms. Tara, a judge and/or a jury.

And what we’re FOIA-ing about is a situation involving a pissy state’s attorney who doesn’t know what she’s doing in her job, and is trying to rope in anyone who says anything negative about her at all…and will do anything she can to cover up how she’s REALLY conducting business in her office.

I’ve just told her on her F^c*book page what she can do to set this right. She can start by coming clean about the documents we’ve FOIA’d for (and which she lied about in the vid—more obfuscation—telling us to FOIA her office when she knew we’d already FOIA’d for exactly what Jack was asking on camera.)

Otherwise, her little house of cards, which is crumbling as you read this, is going to be a complete disaster for everyone she’s targeting, the elder Mr. Fricker or no….but it might be a particular disaster for Tara Wallace if she doesn’t stop the obfuscating RIGHT NOW.

After Hardin County State’s Attorney Tara Cook-Wallace dodges Disclosure Publisher Jack Howser for weeks, he catches up with her as she leaves the courthouse for lunch and asks her if she will resign if he presents proof she is lying about investigating sheriff JT Fricker. She invites the publisher to her office after lunch and then doesn’t come back at her usual time.

Gerald Mahan, public property superintendent for the city, will be resigning effective June 30. Firefighter John Gunning, Disclosure has learned, is set to be suspended for three days as a reprimand.

The resignation was announced after an executive session of the city council this morning, 8 a.m. Gunning’s reprimand, however, was not announced; it was expected that Fire Chief Bill Sommers will address that personally with Gunning, and no announcement will be made.

The actions took place after a brief investigation into use of city equipment. Many feel that the same old tired favoritism is being trotted out in the matter; we’ll have a COMPLETE and in-depth article on it in the JULY SPECIAL EDITION that will hit the stands in TWO WEEKS….be sure those of you who subscribe to the e-Edition have your subscriptions going, as you’re not going to want to miss this.

Aud has issued a press release stating his intent toward the state’s inability to pen a concealed carry law by the Seventh Circuit Court of Appeals ruling deadline of June 9.

“When I assumed the position of White County State’s Attorney,” Aud wrote in his presser, “I swore an oath that I would ‘support the Constitution of the United States and the constitution of the State of Illinois.’ Our government is one with a separation of powers. The authority of my position is to use my discretion in enforcing the law; I do not possess the pen that the members of the General Assembly have that makes our laws nor do I possess the gavel that members of the courts have to rule on the constitutionality of our laws.

“The position that I have taken since the Court’s ruling in December is simple: I will not prosecute any individual under those provisions declared unconstitutional. Regardless if the Court stays the imposition of their ruling for six months or six years or even six minutes for that matter, I believe that we were all put on notice that the law is unconstitutional and has therefore been invalid since its inception. Consequently, I am vehemently convinced that to prosecute any person under a law that has been declared unconstitutional, even with a stayed enforcement, would be a direct violation of my oath of office to support the Constitution. This belief has led my office to declining to prosecute multiple individuals since December under those statutes.”

Aud outlines the same guidelines that Madison and Randolph counties’ prosecutors before him have; please read and understand them before you go carrying concealed in White.

Many people weren’t aware that the Illinois State Police last week advised that they would not honor the individual counties’ wishes and stated in their own press release they would continue to arrest people if found in violation of Illinois’ archaic gun laws.

We just want to remind you that an arrest is not a charge; it takes a prosecutor to charge a crime after an arrest. The arrest is invalid if the prosecutor refuses to file a charge, so there’s nothing that’s going to “follow you the rest of your life” if such an arrest is made by state police in a county allowing concealed carry.

Kudos to Aud; he is quickly proving himself to be one of the finest prosecutors in downstate, and others should take his determination as an example.

Marcus Marshall

“Having considered the facts of record and the applicable law that it is fair and proper to confess error in the trial court proceedings,” Garnati said. “Therefore the defendant Marcus Marshall is entitled to a new trial on the charges of first degree murder.”

Sources tell Disclosure that Garnati, known for being one of the more rude prosecutors in southern Illinois, appears to have come to his realization of error only AFTER court transcripts were presented to him by Marshall’s attorney who made it clear if it came to a court fight that it would be racially charged and very public.

Marshall was found guilty of the 2010 murder of LaQuinn Hudson in 2011 and was sentenced to 85 years in prison.

During closing arguments in the mostly white community of Marion Garnati for some reason felt comfortable using a phrase referring to “our white world.”

Disclosure is not picking sides on the guilt or innocence of Marshall, but is only noting the utter lack of professionalism on the part of Garnati.

“I do not believe I have ever come away from a contact with that man’s office and felt like he gave two shits about the people’s right to know what was going on in their courthouse,” said Disclosure publisher Jack Howser. “Hell I am not sure he even speaks to the general public except during election time, through some mouthpiece in his office as nasty as he is or some written statement like the one that announced his latest screw-up!”

When his office was contacted with further questions from the public, his assistant Jimmy Dean proclaims Mr. Garnati wasn’t taking questions and had no further comment on the matter.

MARION—Folks driving by the creepy bronze statue of Marion mayor Bob Butler have been posing the question of why the statute is of him an not of his son-in-law.

You read that right. Marionites know it: Bob’s son-in-law, it’s being said, is the one who REALLY runs the city. You know, his “son-in-law”? Gail, the city administrator?

That’s right. Bob’s son-in-law is a female: Gail West, Marion city administrator. The job that’s said to be the REAL position that ‘runs the city,’ even though the credit goes to Bob, and he gets a statue erected in his honor. West has held the position for several years, this coming after she and Butler’s daughter, Beth, relocated to Marion from Indianapolis. We’re told that since Gail needed employment, Butler created the position as city administrator, and filled it with West, also endowing her with benefits and retirement. Nothing like being the significant other/husband/wife/whatever of the multi-term mayor (45 years now, so we hear, hence the statue).

And of course, Beth Butler was also put on the taxpayer’s teat, when the school district was persuaded to hire her as Marion Unit 2 School District Music Instructor.

We don’t know what the gals….couple…whatever…were doing in Indy prior to escaping to downstate Illinois, but apparently, for Ms. Beth, it wasn’t enough to keep her employed, and the school district fired her. This resulted in a federal lawsuit being filed against the school district in 2008, which has reportedly been very costly to the taxpayers of Marion.

Maybe the tension in the lawsuit has been what’s created the problems between the two ladylovebirds lately.

Whatever the problem may be, it’s created trouble in paradise. On April 12 of this year, the Marion Police were dispatched to the North Market Street home of Ms. Butler and Ms. West on a Domestic Disturbance Call at 1 a.m. There were four cars reported sent out to the home, where the city administrator allegedly had suffered a beating at the hands of the mayor’s daughter. Ms. West reportedly suffered bruises to the stomach and leg area; the mayor’s daughter reportedly suffered a black eye…which hasn’t seemed to bother her too awful much, as she posted a photo of herself sporting it, this on her Facebook page (and at the time of this investigation, was her profile pic on said page).

Sadly the couple split up as a result of this particular fight, and Ms. West moved out; but since that time, happily they are back together and reconciled.

The whole thing has caused quite a stir in a town where the mayor is making his administration legendary in its length (the aforementioned 45 years). Many have tried to unseat him; all have failed. And, as you know, where there’s such longevity, there’s talk of corruption. Well, there usually IS corruption, but its only uncovered due to the tireless efforts of some people who are tired of seeing the same old people succeed while others work their behinds off and get no glory (like a statue.)
